Will the ATO forgive your tax debt?
Rarely. But there's usually more room to move than the letters suggest.

The ATO doesn't write off tax debt because a business is struggling. There is a formal release for serious hardship, but it's narrow. Only individuals can apply. A company, trust or partnership can't have its tax debt released, and GST, PAYG withholding, superannuation guarantee and Director Penalty Notice debts can't be released at all. Even where serious hardship is clear, most applications are refused. The ATO sets out the rules on its release from your tax debt page.
That doesn't mean the number on the ATO's letter is fixed. General interest charge and penalties can sometimes be reduced on request. A payment plan the ATO will accept can stop enforcement. If the business can't pay what it owes, a formal restructure under the Small Business Restructuring process can reduce the debt across all creditors, ATO included, and a liquidation or bankruptcy can bring it to an end.
Which one fits depends on how much you owe, what's in the company's name or yours, and whether a Director Penalty Notice is already on the way. We look at the whole picture and coordinate the response with the ATO, your accountant and the right people. If you've had a Director Penalty Notice, start with director penalty notices. For the wider picture, see ATO debt.
Plain-English FAQ
Can I ask the ATO to waive interest and penalties?
Yes. You can ask the ATO to remit the general interest charge and some penalties, and it has to consider the request. It looks at why the debt arose, your compliance history and whether you've acted to fix it. A request backed by a realistic payment plan has a far better chance than a request on its own. Interest keeps accruing while you're on a plan unless the ATO agrees to remit it.
My company owes the tax. Can the ATO forgive it?
No. The serious hardship release is for individuals only. A company's tax debt can be reduced through a Small Business Restructuring plan if the company qualifies, or ended by liquidation. Watch for Director Penalty Notices. Unpaid PAYG withholding and superannuation guarantee can become your personal debt as a director, and those debts can't be forgiven either.
Will bankruptcy clear my tax debt?
For an individual, most tax debts are released when the bankruptcy ends, including income tax. Bankruptcy carries serious consequences, though. You can't manage a company while you're bankrupt, and your assets may be sold. Check the alternatives first. A negotiated payment plan, a debt agreement or a personal insolvency agreement may deal with the debt without the cost of bankruptcy.
