Most business owners under pressure owe more than one creditor, and each one pushes differently. A supplier puts you on stop. The bank reviews the facility. The landlord issues a notice. A creditor serves a statutory demand and the company has 21 days to respond. The danger is dealing with them one at a time, paying whoever shouts loudest, while personal guarantees turn company debt into your debt. We look at everything you owe, work out which pressure is real and which can wait, and coordinate the right response: a negotiated settlement or payment plan, a formal restructure, or a controlled wind-up if trading on isn’t realistic. We don’t take the appointment and we don’t earn from it, so the options we put in front of you aren’t steered.

I’ve been served a statutory demand. How long do I have?

A company has 21 days from service to pay, reach an agreement with the creditor, or apply to the court to set the demand aside. The court application has to be filed inside those 21 days. If nothing happens, the creditor can apply to wind the company up, and the court will presume the company is insolvent. Call us early, not on day 20.

I signed a personal guarantee. Does that put my house at risk?

It can. A personal guarantee lets the creditor come after you personally if the company doesn’t pay, and winding up the company doesn’t cancel it. That’s why we look at guaranteed debts first and plan around them.

Should I pay the creditor that’s pushing hardest?

Not until you’ve looked at the whole picture. A payment to one creditor ahead of others in the months before a liquidation can be clawed back as an unfair preference. It can also leave the debts that carry personal liability, like guaranteed loans or ATO debts under a DPN, unpaid. Get the order right first.
